Participation in a PGA HOPE Southwest Play Day is a voluntary recreational opportunity made available to eligible PGA HOPE graduates. By registering for or participating in a Play Day, I acknowledge and agree with the following:
1. Voluntary Participation and Assumption of Risk
I understand that my participation in any PGA HOPE Southwest Play Day is entirely voluntary.
I understand that playing golf, practicing golf, operating or riding in a golf cart, walking on a golf course, using practice facilities, and participating in related recreational activities involve inherent and other risks. These risks may include, but are not limited to, being struck by golf balls, golf clubs or equipment; slips, trips and falls; uneven terrain; adverse weather; lightning; extreme temperatures; wildlife; interactions with other participants; golf cart accidents; physical exertion; and other risks normally associated with golf and recreational activities.
I knowingly and voluntarily assume the risks associated with my participation, including the risk of personal injury, illness, property damage, disability or death, to the fullest extent permitted by applicable law.
2. Release and Waiver of Liability
To the fullest extent permitted by applicable law, I release and agree to hold harmless the Southwest PGA Foundation, PGA HOPE Southwest, the Southwest Section PGA, their respective officers, directors, employees, representatives, volunteers, PGA Professionals, agents, sponsors and program partners from claims, demands, causes of action, damages or liabilities arising from or related to my voluntary participation in a PGA HOPE Southwest Play Day, including claims arising from ordinary negligence.
This release is not intended to waive claims that cannot lawfully be waived, including liability resulting from gross negligence, reckless conduct, willful misconduct or other conduct for which liability cannot be released under applicable law.
I further understand that the golf course, club or other participating facility may maintain its own liability policies, waivers, rules and requirements and that this acknowledgment does not replace any waiver or agreement required by that facility.
3. Participating Facility Rules
I understand that each Play Day is hosted at an independently operated golf course, club or participating facility.
My participation is subject to all rules, regulations, policies, dress codes, pace-of-play requirements, golf cart policies, safety procedures and standards of conduct established by the participating facility.
I agree to follow the instructions of facility management, PGA Professionals, Southwest PGA Foundation representatives and authorized Play Day personnel.
Participation in PGA HOPE Southwest does not provide me with any special exemption from a facility's rules or policies.
4. Participant Status — No Representation or Agency
I understand and acknowledge that my participation in a PGA HOPE Southwest Play Day does not make me an employee, agent, representative, spokesperson or authorized representative of PGA HOPE Southwest, the Southwest PGA Foundation or the Southwest Section PGA.
I will not represent, imply or communicate to any individual, organization, business, golf facility, media outlet or member of the public that I have authority to speak, act, make commitments or enter into agreements on behalf of PGA HOPE Southwest, the Southwest PGA Foundation or the Southwest Section PGA.
My participation is solely in my individual capacity as a participant.
5. Participant Conduct
PGA HOPE Southwest Play Days are intended to provide veterans with opportunities for recreation, camaraderie, connection and continued engagement through the game of golf.
I agree to conduct myself in a respectful, courteous and appropriate manner toward fellow veterans, PGA Professionals, golf facility employees, volunteers, guests and other individuals encountered during a Play Day.
Conduct that is disruptive, threatening, abusive, discriminatory, unsafe, destructive, excessively intoxicated, contrary to facility rules, or otherwise not befitting the values, reputation or purpose of PGA HOPE Southwest may result in immediate removal from the activity and/or suspension or permanent removal from future PGA HOPE Southwest Play Day opportunities.
The Southwest PGA Foundation and PGA HOPE Southwest reserve the right, in their reasonable discretion, to determine eligibility for and continued participation in Play Day opportunities.
6. Personal Responsibility
I am responsible for determining whether I am physically able to participate safely in golf and related activities.
I agree to use reasonable care for my own safety and for the safety of others. I will not participate when my physical condition, medications, alcohol consumption, impairment or other circumstances make participation unsafe.
I understand that I am responsible for my personal property and equipment during the Play Day.
7. Medical Emergencies
If I become injured or experience a medical emergency during a Play Day and I am unable to provide instructions, I authorize reasonable emergency assistance to be obtained on my behalf.
I understand that the Southwest PGA Foundation and PGA HOPE Southwest do not provide medical insurance for participants and that I am responsible for my own medical expenses and insurance coverage.
8. Play Day Availability
I understand that PGA HOPE Southwest Play Days are a privilege and recreational opportunity and are not guaranteed benefits or entitlements.
Play Days may be changed, postponed or cancelled due to weather, course conditions, facility availability, safety concerns, participation levels or other circumstances.
Participation in one Play Day does not guarantee participation in future Play Days.
9. Acknowledgment
By checking the acknowledgment box below, I confirm that:
- I am voluntarily choosing to participate in PGA HOPE Southwest Play Days.
- I have read and understand this Participant Waiver, Release of Liability and Code of Conduct Acknowledgment.
- I understand and voluntarily assume the risks associated with participation.
- I agree to comply with all rules and regulations of participating golf facilities.
- I understand that I do not represent, speak for or act on behalf of PGA HOPE Southwest, the Southwest PGA Foundation or the Southwest Section PGA.
- I understand that inappropriate conduct or behavior not befitting the PGA HOPE Southwest program may result in my removal from a Play Day and/or loss of eligibility for future Play Day opportunities.
- I agree to the release of liability stated above to the fullest extent permitted by applicable law.
- I understand that my electronic acknowledgment has the same effect as my physical signature to the extent permitted by applicable law.
